How Can Canadian Small Businesses and Nonprofits Reduce AI Risk?

You do not need a complex AI strategy to get started.

The most effective first step is setting clear, written expectations about how AI can and cannot be used.

  • Defining acceptable and prohibited uses of AI tools

Applicable AI Regulations Across Canada

Is AI regulated differently across provinces? What do employers need to know?

As of 2026, Canada does not yet have a comprehensive federal law that governs how private-sector employers must use AI in the workplace. That means there isn’t a single “AI law” you must follow from coast to coast. Instead, employers must rely on a mix of existing laws and emerging provincial rules that affect how AI can be used responsibly at work.

This means there isn’t a standalone federal AI regulation that applies to workplaces, and a federal AI bill (Bill C-27) did not pass into law. However:

  • Privacy laws, like the Personal Information Protection and Electronic Documents Act (PIPEDA) or other legislation applying to personal or health information, still apply if your organization collects or uses personal information through AI tools. That means you must be transparent about what data you collect and how it’s used.
  • Human rights laws at all provincial, territorial, and federal levels still prohibit discrimination based on protected characteristics, including where AI may contribute to biased outcomes.
    In other words: even without an AI law, existing privacy, employment, and human rights laws already regulate AI by impact, not by name.

Ontario: Leading the Way on AI Transparency

Ontario is currently the only province to pass a law that directly regulates AI use in the workplace:

  • Employers with 25+ employees who use AI to screen, assess, or select applicants must disclose that use in job postings – a requirement that started January 1, 2026.
  • Ontario employers with 25+ employees are also required to have an electronic monitoring policy (which can include AI monitoring of productivity or communications) explaining how and why monitoring is done, even if they are not currently monitoring their employees.
  • The Ontario Human Rights Commission (OHRC) has also published a Human Rights AI Impact Assessment tool to help organizations evaluate and mitigate bias and discriminatory risks when adopting AI.

Québec: Automated Decision Transparency Under Privacy Law

Québec doesn’t have a specific “AI law,” but its privacy regime under Law 25 has AI implications:

  • When a decision is made exclusively through automated processing, individuals have the right to be informed of that fact.
  • Québec’s rules also require you to let people request information about the personal data used, and correct it if needed. This can apply to AI decisions affecting candidates or employees, for example, automated screening or automated performance categorization.

Other Provinces: Focus on Existing Laws, Not AI-Specific Rules

Most other provinces do not yet have AI-specific legislation, but employers must still comply with:

  • Provincial privacy laws (e.g., Alberta’s and British Columbia’s PIPA) when personal information is processed by AI systems.
  • Human rights acts/codes that prohibit discrimination, including outcomes influenced by AI systems.
  • Minimum employment/labour standards that apply regardless of how AI is used (e.g., equity in hiring, performance management, accommodations, etc.).
